Claims-Made Policies respond to claims based on when they’re reported to your insurer, not when the incident occurred, making continuous coverage with prompt notification essential — any gaps, unreported circumstances, or incomplete disclosure at renewal can leave you exposed for past work or exclude future related claims. The continuity clause in these policies establishes an unbroken chain of protection by linking your current policy to previous ones with the same insurer, setting a “continuity date” (typically your first policy date) that prevents claim denials based on circumstances you weren’t aware of at prior renewals. To maintain this protection, you must renew with the same insurer without gaps and carefully answer the standard disclosure question at each renewal: “Are you aware of any fact, circumstance or situation which could reasonably be expected to give rise to a claim against you or any person or entity to be covered under this insurance?” — failing to disclose known circumstances or allowing coverage to lapse can permanently compromise your protection for past activities.
