In Western Australia, if you employ anyone considered by the Workers Compensation and Injury Management Act 2023 to be your ‘worker’ the Act requires you to hold a current and paid workers compensation policy. Other Australian states and territories have their own workers compensation legislation to similar effect.

You will need to submit an estimate of the remuneration you expect to pay to your ‘workers’ and pay the applicable premium. ‘Workers’ include your general workers; full time, part time and casual. Working directors of a propriety limited or limited company can opt in. Sole traders or partners in other business structures cannot opt in.

Individual contractors are considered your ‘workers’ under certain circumstances and when you are principal engaging contractors to perform the work of your business, you will need to include the contractors and their workers in your policy and pay the applicable premium unless you can prove the contractor has their own policy.
